Key Information for Arraignment in Muscogee Creek Nation Court
Your loved one is going to be heading to an arraignment in Muskogee Creek Nation. What do you need to know? My name is Ted Hasse. I practice in federal and tribal courts in Oklahoma, Muskogee Creek Nation.
What you will have experienced if you’re heading to an arraignment is you may have been sent a summons after a criminal complaint and information has been filed by the Attorney General’s Office for the Muskogee Creek Nation. When that happens, that’s good news. It means that you have an opportunity to show up in court and to leave and walk away without some significant bond being set.
Defendants Arriving at Arraignment
More often, defendants will be arriving at arraignment while they’re in custody, depending on the charge. Well, one charge where we see defendants that are not used to being in custody are DUI charges. Now, it’s a particularly difficult situation for defendants to end up on a DUI charge in Muskogee Creek Nation because it is difficult to get bonds set or, I should say, they take too long to set bonds and sometimes people are sitting for too long.
Typically, on a state DUI charge, people are going to be, for sure, walking out of jail within 24 hours. The same in the Cherokee Nation with the Muskogee Creek Nation. The process just hasn’t been set up properly with the counties to see that happen, so people can end up sitting for days.
The Arraignment Process
Once you have appeared before, you’ll get your initial appearance. Usually, at the initial appearance, then there’ll be an arraignment by which defendants will be presented with the charges. At that point, they’ll have the opportunity to enter their not-guilty pleas and move forward with the process. At that point, at an arraignment, judges will set the defendant for a disposition date, which I’ll talk about in a later video.
