Domestic Violence Charges
Defendants on domestic violence charges in Muscogee Creek Nation, what do you need to know? My name is Ted Hasse. I practice law in federal and tribal courts in Oklahoma. Muscogee Creek Nation District Court is a place where defendants can oftentimes get better results on average than they would expect to be getting in a state court, maybe a county court.
However, there are certain charges where, you know, if it’s not the case across the board, there’s certain charges like domestic violence charges where you can potentially be worse off in tribal court and there’s a few reasons why. Generally, there is a culture there where this is a charge where it’s taken very seriously while there seems to be more leniency on certain other charges or, you know, most other charges. Domestic violence charge is one that is taken very, very seriously.
Additionally, one factor that seems to be weighing against defendants is kind of the funding and the power of the victim services down at Muscogee Creek Nation. At this time, they are at outside of the attorney general’s office, they are building their own, they have an enormous amount of resources, they’re building their own legal department, and they have, you know, very aggressive victims advocates who can put a lot of pressure on the on the nation’s prosecutors at the attorney general’s office.

What I find is, you know, they’ve got a lot of resources, these victims advocates will get involved and, you know, they will push for, you know, sometimes unreasonable results. And, you know, my experience, it looks like my experience, it looks like they can make it, you know, difficult for the parties to come to a resolution through a plea agreement sometimes. So in any case, there’s, you know, there’s a general culture of taking these domestic violence cases seriously.
But then there’s, you know, practically speaking, there’s a whole department of folks who are advocating on behalf of alleged victims that are pushing for harsh sentencing. If you are a defendant facing a domestic violence charge, you’re going to want to find a good retained counsel, somebody who is experienced with the specific attorneys and specific prosecutors who are handling these cases. I’m one of those attorneys. It’s always my goal to get the best possible results, no matter what for my clients.
Most important, I tell folks that are giving me a call that they need to make sure that they are working with a criminal defense attorney for any charge in Muskogee Creation Nation. You need to be working with an attorney who actually works in that court, just isn’t in a situation where they happen to be also licensed there. You want to have somebody who is there every week, who is working with defendants regularly and working with the nation on a regular basis. They’re going to get different results for you.
