Exploring Alternatives to Prison in Muscogee Creek Nation Criminal Cases
My name is Ted Hasse. I’m a Muscogee Nation tribal court attorney practicing in federal and tribal courts here in Oklahoma. This is the second part of a series answering questions that have been submitted to me.
The question is: Are there alternatives to prison time in Muscogee Creek Nation on a criminal charge?
Sentencing Options in Muscogee Creek Nation Courts
Like most jurisdictions, Muscogee Creek Nation courts have a broad range of sentencing options. A judge doesn’t always have to send someone to prison. Depending on the case, a judge might order probation, fines, community service, treatment programs, or other alternatives. Much of this depends on the facts of the case, the recommendations of the Attorney General’s Office, and whether there’s a plea agreement.
Now, if a judge does sentence someone to incarceration, that sentence has to be served. There’s no system in place to “trade out” a prison sentence for something else unless the defendant succeeds on appeal or convinces the judge to reconsider. In a later segment, I’ll go into more detail about what prison sentences actually look like for defendants in Muscogee Creek Nation.
Judicial Discretion and Plea Agreements
But the key point is: judges in tribal courts do have discretion, and they can often be persuaded to consider alternatives to prison—especially if both sides reach an agreement in a plea deal.
